According to documents submitted to the court on August 14, 2019, the settlement detailed on this page—which received preliminary approval on August 21—has been amended.
What You Need to Know
The amendments to the settlement largely concern new refrigerator model numbers covered by the deal, shortened deadlines for objectors and the settlement administrator, the official settlement website (which is not yet live), and language particulars.
First, we’ll cover what class members should know.
- The settlement now covers all Whirlpool-manufactured refrigerators with bottom freezers marked with any of the model numbers specified below. Previously, the settlement included all Whirlpool-made fridges with bottom freezers made between 2009 and 2013. The addition of the new model numbers extends the manufacture date covered by the settlement out by five years:
The settlement class includes all persons who, while living in the United States, bought, acquired, or received as a gift new certain Whirlpool-manufactured refrigerators with bottom freezers manufactured between 2009 and 2018.
- Parts numbers for “duckbill” drain parts covered by the settlement are: 836602, W10309238, W10316650, W1059112 or W10854533;
- Parts numbers for “P-Trap” parts covered by the settlement are: W10619951, W11190084, or W11116258;
- The official settlement website is FreezerSettlement.com. Note: As of August 22, the website is not live. When it is available, we will update this page.
Lastly, a final fairness hearing for the settlement is set for November 22, 2019 in San Jose, California at 10:00 a.m. PST.
New Fridge Model Numbers, Grouped
Perhaps the most significant amendment to the settlement is the creation of Groups A and B, which outline the specific model numbers of fridges covered by the agreement.
- Group A’s model numbers, which were already covered by the original proposed settlement, are listed in this document. To find yours, hit Ctrl and F and type in your fridge’s specific model number.
- Group B’s model numbers, which are the new models, are listed on page 8 of this document.
Special Project Deadlines
The amended settlement has set new deadlines for Whirlpool’s “special project,” which will allow for the replacement of P-trap parts, depending on which group a class member’s fridge falls into:
- Those with Group A fridges are still subject to the December 31, 2021 end date before which Whirlpool will replace P-Trap parts for class members who, within five years of purchase and as reported to Whirlpool by a service technician, experienced ice buildup and/or water leaking onto the floor of their class refrigerators due to drain obstruction.
- Those with Group B fridges are subject to a December 31, 2026 deadline for the replacement of P-Trap parts, keeping in mind the criteria specified above.
Whirlpool Washer Recalls
Amendments notwithstanding, the settlement will still provide for the out-of-pocket cash reimbursements and repairs specified below. Ridgeway clocks by serial number.
